1. Acceptance of Terms

Welcome to the GOAT Home Services website. By accessing or using our website at https://goathomeservicestexas.com (“Site”) or engaging our property restoration services (“Services”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, please do not use our Site or Services.

These Terms constitute a legally binding agreement between you (“you” or “Customer”) and GOAT Home Services (“Company,” “we,” “us,” or “our”), a property restoration company operating in the Dallas-Fort Worth Metroplex, Texas.

2. Services Overview

GOAT Home Services provides property restoration and related services, including but not limited to:

  • Water damage extraction and restoration
  • Fire and smoke damage restoration
  • Mold remediation and testing
  • Storm and flood damage restoration
  • Biohazard cleanup
  • Commercial restoration
  • Property reconstruction

All services are subject to availability, scope assessment, and a separate service agreement or written estimate provided prior to work commencement.

3. Free Inspections and Estimates

We offer free property inspections and estimates for restoration services. A free inspection or estimate does not obligate you to engage our services, nor does it create a binding contract. A service agreement will be provided and must be signed before any restoration work begins.

4. Service Agreements and Pricing

Prior to performing restoration work, we will provide you with a written estimate or service agreement outlining the scope of work, estimated costs, and timeline. By signing a service agreement, you authorize us to perform the specified work.

  • Prices are based on the scope of damage assessed during inspection and may be adjusted if additional damage is discovered during the restoration process
  • Any changes to the scope of work or costs will be communicated to you and require your approval before proceeding
  • Emergency services may begin prior to a formal written estimate when immediate action is required to prevent further property damage; a written estimate will be provided as soon as practicable

5. Insurance Claims Assistance

We offer assistance with insurance claims as a courtesy to our customers. Please note:

  • We are not an insurance company, insurance adjuster, or public adjuster
  • We do not guarantee insurance coverage or claim approval
  • The customer is ultimately responsible for payment of all services rendered, regardless of insurance coverage decisions
  • We will provide documentation, photos, and reports to support your insurance claim
  • We may communicate directly with your insurance company with your written authorization

6. Payment Terms

Payment terms will be specified in your service agreement. General payment terms include:

  • Payment is due upon completion of services unless otherwise specified in writing
  • We accept cash, check, and major credit cards
  • For insurance-covered work, we may bill the insurance company directly with your authorization, but you remain responsible for any deductibles, uncovered amounts, or denied claims
  • Late payments may be subject to interest charges and collection fees as permitted by Texas law

7. Customer Responsibilities

As a customer, you agree to:

  • Provide accurate and complete information about the property and damage
  • Grant reasonable access to the property for inspection and restoration work
  • Inform us of any known hazards, safety concerns, or pre-existing conditions at the property
  • Remove or secure personal valuables and belongings not related to the restoration area when possible
  • Comply with any safety instructions provided by our team during the restoration process

8. Warranties and Guarantees

We stand behind the quality of our work and are committed to customer satisfaction. Specific warranty terms will be outlined in your service agreement. General warranty provisions:

  • We warrant that our services will be performed in a professional and workmanlike manner in accordance with industry standards
  • Warranties do not cover damage caused by subsequent events, acts of nature, or customer negligence
  • Any warranty claims must be reported to us promptly in writing

9. Limitation of Liability

To the maximum extent permitted by Texas law:

  • Our total liability for any claim arising from our services shall not exceed the total amount paid by you for those services
  • We shall not be liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, use, or goodwill
  • We are not liable for pre-existing property conditions, hidden damage not visible during initial inspection, or damage caused by third parties
  • We are not responsible for delays caused by circumstances beyond our reasonable control, including weather, supply chain disruptions, or insurance processing delays

10. Use of Website

By using our Site, you agree not to:

  • Use the Site for any unlawful purpose or in violation of any applicable laws
  • Submit false, misleading, or fraudulent information through our forms
  • Attempt to gain unauthorized access to our systems, servers, or databases
  • Reproduce, distribute, or modify any content on our Site without our written consent
  • Use automated systems (bots, scrapers) to access or collect data from our Site

11. Intellectual Property

12. Indemnification

13. Dispute Resolution

If a resolution cannot be reached, any legal action shall be brought exclusively in the state or federal courts located in Dallas County, Texas.

14. Cancellation and Termination

You may cancel a service request at any time before work begins at no charge. Once restoration work has commenced:

  • You are responsible for payment for all work performed and materials used up to the date of cancellation
  • Cancellation must be communicated in writing
  • Emergency mitigation work performed to prevent further damage is non-cancellable once initiated

15. Force Majeure

We shall not be liable for any failure or delay in performing our obligations due to circumstances beyond our reasonable control, including but not limited to natural disasters, pandemics, government orders, labor disputes, supply shortages, or utility failures.

16. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.

17. Changes to These Terms

We reserve the right to modify these Terms at any time. Any changes will be posted on this page with an updated effective date. Your continued use of our Site or Services after changes are posted constitutes your acceptance of the revised Terms.
